Can an employer cancel health insurance without notice? |
I found out 4 months after coverage had been cancelled. I started receiving claim denials from the insurance company stating insurance no longer in effect, and that it was cancelled 4 months earlier. Now I have around $3,000 in bills that they want me to pay. Employer said, I been meaning to talk to you about that! I said when, when I had a huge hospital bill or some serious illness. He says he will pay for these bills, but I don't believe him, since he's been bouncing payroll checks and talking about lay offs. What are my legal rights here? Ok, the company is a DBA under an LLC he owns. How would that factor in the equation? Does he have to close both businesses to file bankruptcy? You have a right to get an attorney and sue him, to get his company to pay the bills. He's right, he's obligated to pay them. But he's also obligated to meet payroll, and it's likely he's going to go bankrupt before you see a penny. That is wrong... talk to your employer and seek legal advice if needed. Check your paystubs to see if you were being charged for it. Every company involved in group health care coverage is supposed to inform the group months ahead of time that they will not provide group insurance anymore. The latest should be the last month before it expires. |
